On 03.30.2023 Legislative Decree n. 24 of 24 of 10 March 2023 entered into force. The decree has implemented the EU directive 2019\/1937 which concerns the protection of \u201cwhistleblowers\u201d, those who reports violations of national or European regulations that damage the integrity of the public administration or private entity, of which they have become aware in a work context.<\/span><\/p>


In compliance with the decree, EXENIA<\/strong> has established a system for the collection and management of the reports, see “WHISTLEBLOWING MANAGEMENT”<\/span><\/span><\/strong><\/a><\/span>\u00a0<\/span>procedure for more information.<\/span><\/span><\/p>

Who can report?<\/span><\/b><\/span><\/p>

The following subjects can make reports, even anonymously: employees and self-employed workers, freelancers and consultants, collaborators, suppliers, volunteers, interns, shareholders of the company, individuals who have working relationships with EXENIA.<\/span><\/p>

Each report must be adequately detailed; it must contain enough details to allow the facts reported to be verified (elements that allow the subjects involved to be identified, the context, place and period of the facts reported and supporting documentation).<\/span><\/p>

\u00a0<\/span><\/p>

How to make a report?<\/span><\/b><\/span><\/p>

Reports can be transmitted using one of two official channels:<\/span><\/p>

\u00a0 \u00a0 \u00a0 \u00a0-on \u201cMy Whistleblowing platform\u201d<\/span><\/span><\/a>, \u00a0that guarantee the confidentiality of the whistleblower’s identity by using secure protocols and \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 encryption tools. This channel allows the reporting party to check the processing status and to send and receive communications.<\/span><\/p>

How are reports are handled?<\/span><\/b><\/span><\/p>

Reports are managed by the Finance and HR<\/strong> function.<\/span><\/p>


Within 7 days from receipt, an acknowledgment receipt of the report will be sent and within 3 months of this notice,\u00a0\u00a0feedback on the follow-up that is given or intended to be given to the reporting.<\/span><\/p>

Guarantee of confidentiality and protections<\/span><\/b><\/span><\/p>

In compliance with Legislative Decree 24\/2023, absolute confidentiality<\/strong> is guaranteed to the reporter, and to people involved in the report. In the case of anonymous reports, it is not possible to trace the identity of the reporter.<\/span><\/p>

Any form of personal or professional retaliation must not permitted or tolerated<\/strong>. If you think you have suffered retaliation due to reporting, you can report it to the National Anti-Corruption Authority (ANAC).<\/span><\/p>

All processing of personal data is following the legislation on the protection of personal data.<\/span><\/p>

In the event that after reporting you do not receive any feedback (the acknowledgment of receipt and\/or the response to the follow-up given to the report), or you have reasonable reasons to believe (based on concrete circumstances and information that can actually be acquired) that the report internal action would not be effectively followed up or that the same could lead to retaliation, or that the violation may constitute an imminent or obvious danger to the public interest, it is possible to send a report to ANAC with the IT platform.<\/span><\/span><\/span><\/p>
